Abstract
regulation of hazardous and toxic waste disposal based on Law of the Republic of Indonesia Number 6 of 2023 concerning Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law and law enforcement against perpetrators of hazardous and toxic waste disposal carried out by PT GRAND PERINTIS INDUSTRY. This research uses normative legal research methodology. This legal study focuses on examining legal principles, namely guidelines that provide an assessment of the law, which ultimately leads to an ethical assessment.In applying punishment to criminal offenders in criminal case decisions, judges must pay attention to various considerations, as the basis for judges imposing punishment. The judge's consideration is one of the most important aspects in determining the realization of the value of a judge's decision that contains justice and contains legal certainty, besides that it also contains benefits for the parties concerned so that the judge's consideration must be addressed carefully, well and carefully. If the judge's consideration is not thorough, good, and careful, the judge's decision derived from the judge's consideration will be canceled by the High Court / Supreme CourtThe use of criminal law is the last resort, except for violations that have a negative impact on safety, security, and the environment. 1. There needs to be a clearer comparison regarding the application of administrative sanctions and criminal sanctions 2. There is a need for more intense supervision to prevent violations of environmental waste dumping provisions. Keyword: hazardous and toxic waste disposal, regulation of hazardous and toxic waste disposal based on Law of the Republic of Indonesia.
