Abstract

Globalization has increased international cooperation across various fields, often
formalized through Memoranda of Understanding (MoU). Although not always
legally binding, MoU contain legal terms that carry specific pragmatic and legal
implications, requiring accurate translation to preserve their meaning and legal
effect. This study aims to identify and classify legal terms in six MoUs involving
the Ministry of Communication and Information Technology of the Republic of
Indonesia and ministries from six countries (Germany, Singapore, Thailand, China,
Timor Leste, and Saudi Arabia), as well as to analyze the translation procedures
used based on Peter Newmark theory. This research employs a descriptive
qualitative method, using six MoU documents in English and Indonesian as the data
source. The analysis identified 50 legal terms, consisting of 22 purely technical
terms, 21 semi-technical terms, and 7 everyday terms. Six types of translation
procedures were found, consisting of 18 functional equivalent, 8 recognized
translation, 4 modulation, 7 transference, 4 descriptive equivalent, and 2 formal
equivalence. The findings indicate that in translating legal terms in MoU,
maintaining the functional meaning of terms is crucial to ensure accuracy and legal
relevance.
